Article 22-1. Ensuring security in the field of communication


1. In order to protect national interests and prevent the informational isolation of the Republic of Kazakhstan state-authorized agencies in compliance with the guarantees provided to investors, have control over the activities of organizations engaged in the management and operation of trunk communication lines and communication networks that are managed or owned organizations with foreign participation in the manner determined by this Law.
2. Responsibility of government agencies, organizations, officials and citizens is to take measures to ensure uninterrupted and stable operation of communication networks, in order to maintain security Republic of Kazakhstan, including in particular the period and in emergency situations of natural and manmade, quarantines and other emergencies.
3. Agencies and officials of the Republic of Kazakhstan to the decision-making on the construction, operation and development of communication networks should be guided by the requirements of the compliance of national security Republic of Kazakhstan.
4. Prohibited:
1) the management or operation of the main communication lines by foreigners, stateless persons and foreign legal entities;
2) the establishment and operation of the Republic of Kazakhstan communications networks, the control center which is located outside of it;
3) purchase or otherwise obtain the ownership of legal entities and individuals on their own or as part of a group of individuals more than ten percent of the voting shares and stakes organization that owns and (or) carrying out activities on the management or operation of the communication line as the operator and long-distance (or) international communications without the consent of the authorized body, which is determined by the Government of the Republic of Kazakhstan;
4) to foreigners, stateless persons and foreign legal entities directly and (or) indirectly, own, use, dispose of and (or) to manage in aggregate more than 49 percent of the voting shares and stakes a legal entity carrying out activities in the telecommunications industry as the operator of long-distance and (or) international communications, which owns land (cable, including fiber optic, microwave) communication lines;
5) putting into operation of communication networks that do not meet the requirements of regulations for the search operations.
5. Other restrictions regarding ownership of shares (stakes, stocks) or participation in organizations working on national security in the area of communication established by the legislation of the Republic of Kazakhstan.

Article 23. Ensuring the safety of public
Institutions


1. Ensuring the safety of public institutions is a fundamental responsibility of government bodies and officials of the Republic of Kazakhstan, one of the criteria for evaluating their performance.
2. Requirements for national security necessarily taken into account when:
1) strategic planning areas and stages of socio-economic development;
2) the development, adoption and execution of legislative, administrative and other acts of state bodies and officials.
3. Will not accept any kind has been making and committing acts contrary to the interests of the establishment and smooth functioning of:
1) Unified government of the Republic of Kazakhstan, including its law enforcement agencies, security services and the courts;
2) a single legal system of the Republic of Kazakhstan.
4. The State shall take measures to:
1) increasing the credibility and prestige of public service;
2) developing institutional arrangements that do not allow entry into the civil service of persons who do not qualify.
5. Public servants of the Republic of Kazakhstan in its activities shall be guided by national interests. Civil servants are forbidden to take decisions and actions that could call into question the credibility of the government, leading to the use of official position in the off-duty benefit.
6. Opened in the legislation limits and must be controlled character of decision-governmental officials decisions related to:
1) the distribution of the republican and local budgets, including public procurement and credit allocated resources;
2) the issuance of permits and licenses;
3) providing economic entities established by law privileges and preferences;
4) privatization of state property.


Article 24. Ensuring external security


1. In order to obtain international guarantees for the national security of the Republic of Kazakhstan participated in the international (global, regional) security, part of which is the national security of Kazakhstan.
2. Ensuring national security in the area of foreign relations is to:
1) participation in international efforts to build a global world order;
2) promoting and sustaining an effective system of collective security in the geopolitical environment of Kazakhstan;
3) participation in international organizations whose work meets the national security interests of the Republic of Kazakhstan;
4) participation abroad in activities aimed at ensuring national security in accordance with international treaties of the Republic of Kazakhstan;
5) decision, where necessary, together with the adjacent states of issues relating to national security.
3. Republic of Kazakhstan:
1) to implement a reliable border control develops and strengthens the system of protection of state borders;
2) establish a national system for monitoring the airspace of the State with its integration in a similar international monitoring system;
3) take all necessary measures to prevent illegal immigration.
4. Not allowed to enter the Republic of Kazakhstan of foreign citizens and stateless persons engaged in subversive activities against the Republic of Kazakhstan, has publicly opposed to the sovereignty, territorial integrity of Kazakhstan, the unity of its people, social harmony and political stability in the country. Foreign nationals and stateless persons residing on the territory of the Republic of Kazakhstan and to prevent similar public appearances, are subject to deportation from the country, have a different responsibility in accordance with the laws and treaties of the Republic of Kazakhstan.
