Article 15. Security Council


1. The Security Council is an advisory body to the President of the Republic of Kazakhstan.
2. Organization and procedure of the Security Council determined by the President of the Republic of Kazakhstan.


Chapter 4. Ensuring National Security


Article 16. Guarantees the rights and freedoms of citizens in national security


1. The Republic of Kazakhstan in accordance with national legislation and international treaties to ensure the safety of every person and citizen in their territory. Kazakhstan citizens outside the Republic of Kazakhstan, the State guarantees the protection and patronage.
2. With national security the rights and freedoms of man and citizen may be restricted by law and only to the extent that it is necessary to protect the constitutional order, public safety, human rights and freedoms, health and morals. In this case, citizens and organizations in the procedure established by law are entitled to receive clarification from the national security entities, the limitation of their rights and freedoms.
3. Officials had exceeded their authority, while ensuring national security, are established by law.
4. Guaranteed state support for citizens and organizations that provide assistance in national security, including their legal protection under the laws of the Republic of Kazakhstan.


Article 17. Measures to ensure national security


1. Ensuring national security is achieved by:
1) successively implemented a unified state policy with a clear delimitation of competences and to ensure coordinated functioning of all organs and public officials, as well as citizens who take lawfully participate in the implementation of measures to ensure national security;
2) adequate measures to protect the national interests of the real and potential threats;
3) mutual responsibility of individuals, society and state, the balance of their interests.
2. The Republic of Kazakhstan provides its national security by all means at its disposal the means and methods, including economic, political, military, legal, special (intelligence, counterintelligence), applied unilaterally or in accordance with international treaties.
3. Ensuring national security is to achieve and maintain the necessary level of protection of national interests by:
1) determine the main directions of state activity in this area;
2) to identify and predict threats to national security;
3) the implementation of complex operational and long-term measures to prevent and neutralize threats to national security, including the causes and conditions leading to these threats;
4) the mobilization of forces and means of ensuring national security in cases of imminent threat to national interests, attacks on them, including in cases of extreme emergencies and domestic, transborder and global nature;
5) to take immediate decisions and actions to protect national interests, combat illegal activities, and would infringe on national security, the implementation of other rights limiting measures;
6) localize and eliminate the impacts of encroachment on national interests and implement a set of remedial measures.


Article 18. Ensuring economic security


1. Economic security is ensured by the decisions and actions of state bodies, organizations, irrespective of ownership, officials and citizens, aimed at:
1) promoting the economic independence of Kazakhstan;
2) prevent the economic isolation of Kazakhstan on the world economic system;
3) preservation and strengthening of resource and energy fundamentals of the economy;
4) the maximum reduction in the vulnerability of the state's economy, associated with the impact of possible negative factors arising in the geopolitical environment of Kazakhstan;
5) provision of mutually beneficial cooperation with domestic and international financial institutions, the priority directions of domestic, foreign lending and investment opportunities for rehabilitation and development of the domestic economy;
6)-exceeding the maximum permissible level of state budget deficit and the strengthening of its revenues;
7) prevention of misuse of budgetary funds and public resources;
8) no increase in external debt against the size specified by law on the national budget;
9) prevention of alarming imbalance in the socio-economic development of regions of Kazakhstan;
10) increase the share of Kazakh producers in the economy under the condition to promote competition and limitation of monopolies;
11) to ensure economic growth.
2. In order to protect the national interests of the Republic of Kazakhstan, including the preservation and strengthening of industrial capacities, the state in compliance with the guarantees offered to foreign investors, monitors the status and use of objects of the Kazakh economy, are in management or ownership of foreign companies and organizations with foreign participation.
3. Requirements of national security surely take into account at the conclusion of (changing) contracts for the use of strategic resources of the Republic of Kazakhstan, the execution of these contracts and monitoring their performance, as well as in public decision-making authority to grant or deny permits to a partial or full transfer subsoil subsoil use rights to another person and whether or not to grant permission to dispose of stakes (shares) in a legal entity possessing the subsoil use right.
In this case, the public authority may refuse to permit the applicant to perform the transactions contemplated by this paragraph if it can lead to a concentration of rights to conduct petroleum operations in a single person or group of persons from one country.
Compliance with this condition is necessary, and for transactions with affiliated persons.
4. Will not accept any kind has been making and committing acts contrary to the interests of the establishment and smooth functioning of:
1) market space of the Republic of Kazakhstan, within which the free movement of labor, financial and other resources;
2) a unified and independent financial system of the Republic of Kazakhstan, including the treatment throughout the country, the national currency - tenge;
3) uniform and independent communication and energy systems of the Republic of Kazakhstan.
5. Prohibited and punishable for decisions and actions:
1) preventing the inflow of investments into Kazakhstan's economy;
2) triggering a sharp depreciation of the tenge, the depletion of foreign exchange assets of the state, the growth in public debt that is likely to paralyze the country's economy and currency;
3) contributing to the uncontrolled export of capital abroad.
6. In order to ensure the national security of the Republic of Kazakhstan Republic of Kazakhstan government imposes limits on the transition and the emergence of property rights to strategic resources (objects) of the Republic of Kazakhstan.
