Three acquitted after plea not to revive tensions

Three men accused of threatening to kill a police constable were acquitted after a court head that their trial could rekindle a dispute in the Asian community in Handsworth, Birmingham.

Birmingham crown court was told that at a time of “hight tension” Tariq Somra, a community policeman had allegedly been given a death threat, but had since helped to bring peace to the area.

The prosecution accepted that convicting Raj Kumar, aged 25, and two other men could damage the new-found harmony.

Judge lan Black, QC, directed that verdicts of not guilty be returned on a charge of threatening to kill. He said: “It is obvious that within your community there has been much tension. It is equally obvious that the restoration of peace is of paramount importance. With that in view the prosecution have sensibly been willing to accept these pleas.”

The court was told that April PC Somra went to an Indian restaurant in Handsworth while off-duty and the three hurled abuse at him. Mr. Kumar, who played “a leading role”, said he was going to break PC Somra’s legs.

When he left, they followed him. “The threats were becoming more detailed, including threats to burn down his house”, said Peter Arnold, prosecuting.

He added that since the outbreak of rivalry between two sections of the community, there had been a significant improvement in behavior by those concerned and peace and faith in community policing: “PC Somra is held in very high esteem on all sides.”

Judge Black ordered a not guilty verdict on a charge of threatening to destroy property against Mr. Kumar. The prosecution accepted his plea of quilty to a charge of threatening words and behavior, and he was given a conditional discharge.
