He was sentences for the offences of driving while disqualified to consecutive terms of two and our months imprisonment, suspended for two years, his license was endorsed, he was disqualified from driving for three months for each offence and his car was ordered to be forfeited.

The applicant was convicted of an offences, namely of driving while disqualified. He had in his possession at the time he was apprehended the Ford Granada motor car. The remaining question for the magistrate was whether that car had been used by the applicant for the purpose of committing any offence.

The magistrate's conclusion was that the car had been used for purpose of committing the offence of driving while disqualified.

The use of the car was a integral part of the offence. The defendant could not have committed the offence without the car and he must have intended to drive while disqualified when the journey in his car started.
