TASK 64. (a) Study the following Grammar Note related to the Absolute Infinitive Construction frequently used in formal English and analyze the examples given below:

Grammar Note

The Absolute Infinitive Construction (самостоятельный инфинитивный оборот) consists of a noun in the common case and an infinitive and is often used in modern English legal context. Though formally independent of the sentence, being usually put in the final part of the sentence, the Absolute Infinitive Construction is a logical adverbial modifier of time, cause, condition and is rendered in Russian by means of an adverbial clause (with the conjunction ‘причем’).

The infinitive in Absolute Infinitive Constructions usually expresses strong modality and denotes legally-binding actions (recommended, forbidden, preventive,etc.)

(b) Complete the following English sentences by translating the word combinations in brackets. Use the corresponding versions from the box and the Absolute Infinitive Construction where necessary.

(1) Upon the expiry of this Agreement FS shall cease to manufacture, use or sell the Licensed Products, (причем ФС вправе продавать такие лицензионные продукты и выпускать Лицензионные продукты до тех пор, пока не будут израсходованы имеющиеся в наличие запасы сырья). (2) This Agreement may be terminated by OLDISexercising its rights to do so in accordance with Clause 13.1, (причем все права и лицензии, предоставленные по настоящему Договору, теряют силу). (6) OLDIS shall inform FS promptly of any claim arising in respect of which the indemnity given in Clause 11.1 hereof may apply, (причем ОЛДИС не должен признавать эти претензии и идти на их компромиссное разрешение без предварительного письменного согласия ФС). (7) If either party commits a breachof any of the material obligations on its part to be performed or observed under this Agreement, it shall rectify the same within 30 days after notice is received from the other party specifying such breach and requiring rectification, (причем) in case of failure of such rectification (Договор может быть расторгнут другой стороной путем письменного уведомления в соответствии с пунктом 13). (8) The Registrar of the Internationsl Court of Justice shall also, by means of a special and direct communication, notify any state entitled to appear before the Court or international organization considered by the Court, or, should it not be sitting, by the President, as likely to be able to furnish information on the question, that the Court will be prepared to receive, (причем в сроки, указанные Председателем), written statements, or to hear, (причем на публичном заседании, которое должно быть проведено с данной целью), oral statements relating to the question.
