TASK 74. Translate the sample contract clauses below into Russian:
Distributor acknowledges that the trademarks and service marks used by ABC (the “Trademarks”) are the sole property of ABC, parent corporation of ABC, which has given to ABC the right to sublicense the marks as provided herein. The provisions pertaining to use of the Trademarks by Distributor are set forth in a separate trademark license agreement. Distributor shall not use the Trademarks except in the normal course of advertising or selling the Products and except in a manner approved by ABC. All such use shall inure to the benefit of ABC and Distributor shall have no ownership interest in the Trademarks.
Distributor shall not register or attempt to register any Trademark or designation confusingly similar thereto in its own name or in the name of other person in or outside of the Territory or in any way claim or represent that Distributor has any ownership interest in any Trademark.
Distributor shall not, without a prior written consent of ABC, remove or alter any Trademarks, notices, patent numbers, serial numbers, labels, tags or other identifying marks, symbols or legends affixed to any Products or containers or packages containing Products.
Distributor shall promptly notify ABC of any use of the Trademarks by any third party or any use by a third party of similar marks, which may constitute an infringement of the Trademarks. ABC shall have the sole right to institute any proceedings against such third party infringes and Distributor shall cooperate fully with ABC in any action taken by ABC against such third parties, provided that all expenses of such action shall be borne by ABC and all damages which may be awarded or agreed upon in settlement of such action shall accrue to ABC.
Distributor shall not use the Trademarks on or in connection with the manufacture, sale or advertising of any products not supplied to Distributor by ABC.

Дистрибьютор признает, что товарные знаки, используемые «ABC» («Товарные знаки»), являются исключительной собственностью «ABC», материнской компании «ABC», которая предоставила «ABC» право предоставлять сублицензию на указанные Товарные знаки. Дистрибьютор вправе использовать Товарные знаки только в своей деятельности по рекламе или сбыту Товаров и только в порядке, утвержденном «ABC». Дистрибьютор должен незамедлительно уведомлять «ABC» об использовании Товарных знаков третьей стороной или о использовании любым третьим лицом схожих знаков, которое может квалифицироваться как нарушение прав на Товарные знаки.
Дистрибьютор не приобретает никаких имущественных прав на Товарные знаки и не должен регистрировать Товарные знаки или обозначения, сходные с ними до степени смешения, на свое имя или на имя другого лица.

ABC shall not be liable to Distributor or any person for ABC’s failure to fill any orders, for error in filling orders, or for any delay in delivery; provided, however, that if a factory ship date extends more than 14 days beyond the original date, air freight may be negotiated, depending on the circumstances, for all or part of a shipment. ABC’s liability to distributor for defective products is limited to ABC’s obligations under its standard written warranty and Supply Contract. To the fullest extent permitted by applicable law, in no event shall ABC’s liability exceed the price of the product to which the claim relates. In no event shall ABC be liable for the cost of procurement, substitute goods, loss of profits, or for any other special, consequential, or incidental damages, however caused.

Если поставка с фабрики осуществляется с задержкой более чем на 10 дней от первоначально запланированной даты отгрузки, стороны, в зависимости от обстоятельств, могут договориться о поставке всей или части партии Товара авиатранспортом.
